HillWebWorks provides professional web development, digital marketing, and automation services to businesses and individuals. Our Service includes but is not limited to:
- Custom website design and development

- Website maintenance and ongoing support
- Consulting and strategy services
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your business.
- Supply necessary content, images, and materials in a timely manner.
- Provide any required access credentials (domain registrar, existing hosting, etc.) as needed.
- Review and approve designs within a reasonable timeframe.
- Ensure all content you provide does not infringe on third-party intellectual property rights.
- Use the website and services in compliance with applicable laws and regulations.
4. SMS / Text Messaging Program
4.1 Program Name & Description
Program Name: HillWebWorks SMS Communications
Description: By opting in, you consent to receive text messages from HillWebWorks related to your project, appointment reminders, service updates, quote follow-ups, and important account notifications. This is a transactional and service-oriented messaging program; we do not send promotional marketing blasts.
4.2 How to Opt In
You opt in by providing your mobile phone number through our contact form, scheduling widget, or any other intake method and expressly indicating agreement to receive text messages from us.
4.3 Message Frequency
Message frequency varies and depends on your project activity or service interactions. You may receive messages periodically throughout the duration of your engagement with us.
4.4 Message & Data Rates
Message and data rates may apply. Charges are billed by your mobile carrier according to your service plan. HillWebWorks does not charge separately for SMS messages.
4.5 Opt-Out Instructions
You may opt out of SMS messages at any time:
- Reply STOP to any text message we send you. You will receive a single confirmation message and will receive no further messages.
- Reply HELP at any time for help and support information.

5. Use of the Website
By using our website you agree to:
- Use the Service only for lawful purposes and in accordance with these Terms.

- Not use automated scripts, bots, or scrapers without our written consent.

6. Ownership & Licenses
Your Content
You retain full ownership of all content, images, logos, and materials you provide to us. You grant HillWebWorks a license to use these materials solely to deliver our services to you.
Website Access & Ownership
After initial setup or build payment, the website is fully yours. If you are on a subscription plan, your website is hosted and maintained by HillWebWorks as part of your active subscription. At the end of our engagement, we will transfer all access and ownership to you (additional fees may apply for transfer assistance).
Our Tools & Templates
HillWebWorks transfers ownership of domains, code, and frameworks used to build your website upon request. Extra requests outside the agreed scope are subject to additional fees.
Stock Assets
If stock images, fonts, or other licensed assets are used, they remain subject to their respective license terms. HillWebWorks will use appropriately licensed assets for commercial use.
HillWebWorks Website Content
All content on the HillWebWorks website — including text, graphics, logos, and software — is the property of HillWebWorks and is protected by applicable intellectual property laws. You may not reproduce or exploit it without our express written permission.
7. Client Projects & Deliverables
Any work performed for a client will be governed by a separate project agreement or statement of work ("SOW"). In the absence of a separate written agreement, the following default terms apply:
- Payment is due as specified in the project proposal.
- Ownership of deliverables transfers to the client upon receipt of full payment.
- HillWebWorks retains the right to display completed work in its portfolio unless the client requests otherwise in writing.
- Revisions are subject to the scope defined in the project proposal.
8. Timelines & Revisions
We aim to deliver your initial website build within the timeframe specified for your plan. Actual timelines depend on how quickly you provide content, materials, and feedback.
Clients on monthly retainer subscription plans receive unlimited revisions as part of their ongoing service agreement. Project-based clients receive the number of revisions specified in their project proposal.
9. Payments & Subscription
HillWebWorks operates on a recurring subscription model for ongoing management plans. By subscribing, you authorize us to charge your payment method on a recurring basis according to your selected billing cycle.
- All prices are in USD unless otherwise stated.
- Applicable taxes may be added based on your location.
- Subscriptions renew automatically until cancelled.
If a payment fails, we will attempt to notify you and may retry the charge. Continued payment failures may result in service suspension.

10. Cancellation
You may cancel your subscription at any time by emailing hillwebworks@gmail.com. Cancellation takes effect at the end of your current billing period.
Upon cancellation:
- Your website will remain live until the end of your current billing period.
- After that, hosting and active management will be discontinued.
- HillWebWorks does transfer website files and can assist with migration to another host (extra requests are subject to additional fees).
- Continued access to the website through HillWebWorks management requires an active subscription.

11. No Guarantees & Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
While we strive to create effective websites, HillWebWorks does not guarantee:
- Specific search engine rankings or SEO results.
- A certain number of leads, sales, or conversions.
- Uninterrupted or error-free website operation.
We provide services on a best-effort basis and will work with you to address issues as they arise.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HILLWEBWORKS AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO HILLWEBWORKS IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless HillWebWorks and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
14. Accessibility & Compliance Disclaimer
HillWebWorks builds websites using modern accessibility best practices and WCAG-guided standards where feasible. However, HillWebWorks does not guarantee that any website will meet or remain in full compliance with the Americans with Disabilities Act (ADA), WCAG, or any other accessibility regulations. The client is solely responsible for ensuring their website meets any legal or regulatory compliance requirements applicable to their business.
15. Third-Party Services & Links
We may use third-party services to operate our business, including but not limited to:
- Stripe — payment processing
- Meta (Facebook & Instagram) — advertising and lead generation
- Google — analytics and performance tracking
- Calendly — scheduling and appointment booking
- Vercel — website hosting and infrastructure
These services may collect information in accordance with their own privacy policies. HillWebWorks has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party service.
16. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our data practices.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the state in which HillWebWorks operates, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved in the appropriate courts of that jurisdiction.

We may update these Terms of Service at any time. Material changes will be communicated via email or posted on our website. The "Effective Date" at the top of this page will be updated accordingly. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
